Title:Cultural Activities Grant Guidelines of the Hakka Affairs Commission, Taipei City Government

    1.The Hakka Affairs Commission, Taipei City Government (hereinafter referred to as the HAC) has formulated the guidelines for the promotion of Hakka culture, Hakka language, arts, and folkloric activities.
    
    2.Scope of grant:
    (1)Hakka language promotion activities.
    (2)Hakka culture promotion activities.
    (3)Hakka academic research.
    (4)Hakka folk songs study.
    (5)Hakka rural-urban exchange activities.
    (6)Hakka folklore or other religious activities.
    
    3.Grant recipients:
    (1)Individual: Any citizen who has reached the age of 20, is accountable for his/her action and is domiciled in Taipei City (hereinafter referred to as The City).
    (2)Group: Any corporate or non-corporate body, public and private kindergartens and schools at all levels (including community universities) registered with this city government.
Master's degree and doctoral students pursuing studies at public and private universities in the city may apply for academic research grants, which are not subject to the first paragraph of the preceding paragraph.
    
    4.The extent of the Grant:
In accordance with the current annual grant’s budget of the HAC, a portion of the funds required for the activities or research projects proposed by the applicant may be subsidized. In principle, the upper limit of the grant per application case shall not exceed 50% of the total funds planned by the applicant. However, in order to encourage educational institutions to invest in the preservation of the Hakka language and culture, applications from public, private kindergartens and schools at all levels (including community universities) and those with significant results in the transmission of Hakka language, culture, folklore or other religious beliefs are not subject to the 50% restrictions.
The amount of grant is stipulated in each respective scheme.
When an individual or group accepts the HAC's grant in different applications, each case and its amount of grant are determined separately. However, for any individual case where the total amount of the grant from other government agencies accounts for more than half of the total project expenses and where the total amount is over NT$1 million, it shall be handled in accordance with Government Procurement Act and shall inform the HAC and other sponsoring bodies to supervise according to regulations.
    
    5.Principles of the Grant:
Each year, individuals and groups receive grants on the basis of one project in principle.
The Hakka associations which the HAC has been guiding have made significant achievements in the work of transmitting the Hakka language, culture, folklore or other religious beliefs. Those who have passed the review and been approved shall be exempted from the above-mentioned restrictions.
    
    6.Application procedures:
    (1)In the case of an individual, the applicant shall submit his/her identity card, application form, project plan (including the name, purpose, date, location, contents of the project, implementation method, budget amount and details, source of funds, anticipated benefits) and other information in two copies (which may be sent in conjunction with an electronic file) within the deadline set by the HAC. No application will be entertained after the deadline.
    (2)In the case of an organizational applicant, apart from a copy of the certificate of incorporation and the articles of association, the application procedures are similar to the individual requirements of the preceding paragraph (in the case of a school, the applicant should also attach the basic information of the school, the teacher's certificate and the certificate of registration of the private school).
Relevant applications should be completed in accordance with the provisions of each grant program.
    (3)The applicant shall specify the full amount of the expenses, the items and the amount of the grant to be sponsored by the HAC and at the same time, shall also specify the grant items and amount to be paid by other government agencies.
    (4)The information and the related annexures received from the applicant, whether or not the grant is made available, will not be returned. In the event you need these application documents to be returned back, please specify and attach a return envelope with full address and postage or collect them from the HAC within the specified time.
    (5)Failure to submit an application in accordance with the prescribed or time limits shall not be admissible. However, special and important projects approved by this HAC may not be subject to the time limit for application. If the application is submitted within the deadline and the documents are incomplete, the HAC may request the applicant to rectify the application by a prescribed time limit. The HAC will not entertain any rectification beyond this deadline.

    7.Review process:
    (1)The HAC's organizing unit shall conduct the preliminary review in accordance with the guidelines and if qualified, a first instance opinion shall be drawn up by the review group members for a second review.
    (2)The review panel shall consist of three to seven members and shall be convened by the Chairperson of the HAC or a person designated by him or her. Scholars and experts may be invited to participate in the screening if needed.
Review criteria, grant items, and criteria, according to the provisions of each grant plan.
    (3)The applicant shall also be invited to attend the presentation at the time of screening.
    (4)Members of the review panel who have one of the situations listed in Article 32 of the Administrative Procedure Act shall voluntarily recuse themselves.
    (5)Applicants will be notified, in writing, after the results have been approved and signed by The HAC's Chairperson.
    8.Principles to consider a review:
    (1)Assistance in Hakka language promotion, cultural promotion, academic research, the study of songs, urban-rural exchanges, folklore or other religious activities.
    (2)The extent to which the implementation project is detailed and practicable.
    (3)The utilization of funds (including rigorous verification in the presentation of funds, confirmation of funds raised by oneself and application for a grant to other units).
    (4)Past performance.
    (5)To combine the mobilization and use of local community resources.
    9.Assessment:
    (1)In order to implement the project, this HAC will have to send personnel to the field to understand the implementation and performance of the project and provide the necessary support and assessment. 
The essential points of assessment are normally set by each grant plan.
    (2)If the project's related contents or Exhibition of Achievements are involved in a copyright dispute, the applicant shall need to obtain the authorization rights. Failure to provide the authorization rights certificate, the grant will not be made available.
    (3)If the grant’s recipient has any of the following circumstances known to the HAC, it may convene a review panel, record the case according to its seriousness, revoke or cancel the originally-approved grant, and recover all or one of the funds, and his/her application shall not be accepted within two years:
    1.The results of the review by the HAC have been found in violation of the main points of the usual assessment after a written request was made, no improvement has been noticed.
    2.The submitted application materials, activity results reports or other attachments may have omissions or be phony or misleading.
    3.The contents of the activity do not conform to the original application plan.
    4.Where the grant’s funds are not spent for the purpose for which they were intended and the figures made available are inflated.
    5.Those who do not comply with the application plan or are unable to fulfill it.
    6.Refuse to accept assistance or assessment.
    7.Those who have changed their plans without the approval of this HAC.
    8.Other violations of the regulations.
    (4)The first three forms of grant and assessment methods are subject to the provisions of the various grant schemes.
    10.Allotment and write-off:
    (1)The grant is paid after the end of the activity, but if the amount of the grant exceeds a certain amount, it may be paid in half or in full after the HAC has consented to the reasons submitted by the applicant.
The grant amount mentioned in the preceding paragraph shall be stipulated by each grant plan.
    (2)The applicant for the grant shall, within one month of completion of the plan (not later than December 20th), submit the receipts, results reports, statements of actual expenditure, statements of amount of the sponsored item and all proofs of expenditure, and attach a cover sheet to this HAC for write-off after verification in accordance with the Income Tax Act and generally accepted accounting practices. In order to receive grants from more than two governmental agencies, in addition to the verification of supporting documents, results reports, and a breakdown of the actual expenditure, information on the amount of the grants to be appropriated from each agency shall be sent to the HAC, calculated according to the above-mentioned accounting method. As stated above, if any balance is left, it should be returned altogether.
    (3)The income tax deduction for the grant shall be handled and is the responsibility of the applicant of the grant in accordance with the regulations.
    (4)Shall the grant remain uncollected after the HAC has notified the applicant to collect the funds and that there is no legitimate reason for such delay, the HAC shall repeal the grant and the applicant shall not be able to file any application in the following year.
    (5)If the plan for the approved grant is changed, or if it cannot be held for any reason, it shall be reported to the HAC for re-approval one week before the event, and it shall be limited to one time only. If the plan is not handled according to the regulations, the HAC shall repeal the grant. However, force majeure factors are excluded from this.
    11.Other relevant regulations:
    (1)No person who receives a grant from the HAC shall be listed as an employee of the HAC for a remunerated post.
    (2)The recipient shall guarantee that his/her application plan and works do not infringe upon the copyright of others. If there is such a situation, the recipient shall take full responsibility. If the rights and interests of the HAC are impaired or if there is a claim for joint and several liability, the grant recipient shall be fully liable and shall return the grant already received and shall not make any further application.
    (3)The HAC may require the grant’s recipient unit to disclose the results of the grant scheme (including distribution, transmission, release, oral description, performance, exhibition or other means to inform the public) during or after the activities.
    (4)With regard to the relevant documents and activity results’ report materials provided in the case which has received a grant, the recipient shall agree with their employees or other related third parties to authorize the public publication or use of the HAC name during the process of publicity.
    (5)At the time of publication, presentation and other activities or media publicity, the recipient shall be listed as a sponsored unit in accordance with the words "Hakka Affairs Commission of the Taipei City Government" as designated by the HAC and in the manner presented.
    (6)Other matters not specified shall be governed in accordance with the provisions of other relevant laws and regulations.
